Know the obligations of distributor under the GPSR

 

Last June, the new regulation on consumer products, the General Product Safety Regulation (EU) 2023/988 (GPSR), entered into force, with the aim of ensuring a high level of protection of consumer health and safety, while also ensuring the efficient functioning of the internal market.

 

If you are distributor in European Union, it is important to be aware of the new obligations according to GPSR so that you can comply with this regulation and put safe products on the European market.

 

The regulation states that a distributor is any natural or legal person in the supply chain, other than the manufacturer or the importer, who makes a product available on the market. The new obligations for distributors are as follows:

 

  • Verifying that the manufacturer or importer have complied with the marking, instructions and safety information requirements.
  • Verifying that storage or transport conditions do not jeopardise the product’s conformity with the general safety, marking and instruction and safety information requirement.
  • When a product does not conform with the general safety, marking, instruction and safety information requirements, the distributor shall not make the product available on the market unless the product has been made complaint.
  • When a product is a dangerous product or is not compliant, the distributor shall:
    • Immediately inform the manufacturer or the importer.
    • Ensure that the corrective measures to bring in a product into conformity are taken, including withdrawal or recall, as appropriate.
    • Ensure that the market surveillance authorities of the Member States in which the product has been made available on the market are immediately informed through the Safety Business Gateway.
    • Give appropriate details relating to the risk to consumer health and safety, the number of products affected, and any corrective measures already taken.
