Know the obligations of Authorised Representatives under the GPSR

 

The General Product Safety Regulation (EU) 2023/988 (GPSR) is the new European legislation regulating the safety of consumer products in European Union. The aim with this new regulation is to ensure a high level of protection of consumer health and safety, while also ensuring the efficient functioning of the internal market.

 

According the regulation, an authorised representative is any natural or legal person established within the European Union who has received a written mandate from a manufacturer to act on that manufacturer’s behalf in relation to specified tasks with regard to the manufacturer’s obligations under the regulation.

 

An authorised representative shall perform the tasks specified in the mandate received from the manufacturer. The minimum tasks which a manufacturer’s mandate shall perform are:

 

  • Providing market surveillance authorities with information and documentation related to the safety of the product in an official language, when requested;
  • Informing the manufacturer of any sign that a product is dangerous;
  • Informing the competent national authorities about any action taken to eliminate the risks posed by products covered by their mandate through a notification in the Safety Business Gateway, where the information has not been already provided by the manufacturer or upon instruction of the manufacturer;
  • Cooperating with the competent national authorities on any action taken to eliminate the risks posed by products covered by their mandate in an effective manner.
