Brexit & Cosmetic Products: What’s Changing?

 

Since the end of the transition period on 31st December 2020, the UK Statutory Instruments - The Product Safety and Metrology etc. (Amendment etc.) (EU Exit) Regulations 2019 became applicable in Great Britain (GB). Schedule 34 of this text, named the UKCR : United Kingdom Cosmetics Regulations, concerns cosmetic products, and generally mirrors the European Commission Cosmetics Regulation n°1223/2009. These new regulations do not apply to Northern Ireland.

 

From 1st January, 2021, all cosmetic products sold on the British market will have to comply with this new regulation. This includes cosmetics sold in physical stores, as well as those sold in e-commerce.

 

  • A new UK notification portal has been created.
  • The RP must be designated in the UK
  • The PIF must be available in English at the UK RP’s address
  • The safety assessor’s qualifications must be recognised in the UK
  • The UK RP’s name and address must appear on the label
  • The products sold in the UK and made in the EU must specify the country of origin on the label NB. ‘Made in the EU’ is not acceptable; the country must be specified.
  • The responsible persons based in the UK no longer have access to the CPNP. If the notifications have not been retrieved in 2020, they will have to be redone (on the UK and EU portals).
  • Serious Undesirable Effects (SUEs) should be notified on the new UK SUE.
  • A cosmetic product containing nanomaterials not used as a colorant, preservative, or UV-filter must be notified to the Secretary of State, via the UK’s SCPN Portal by the Responsible Person 6 months prior to it being placed on the GB market.
