CPSC issues updated HTS List for eFiling of Certificates of Compliance

On 1 October 2026, the U.S. Consumer Product Safety Commission (CPSC) published an updated version of its HTS guidance for the electronic filing (eFiling) of Certificates of Compliance. The updated document reorganises the approximately 600 Harmonized Tariff Schedule (HTS) codes that CPSC has identified as likely to include products subject to a mandatory consumer product safety standard or that are otherwise considered high risk.

What has changed?

Since 8 July 2026, CPSC has been using specific product flags within U.S. Customs and Border Protection's (CBP) Automated Commercial Environment (ACE) to identify shipments that may require certificate data. The updated guidance now categorises HTS codes according to the flag assigned by CPSC: 

  • CP1: "CPSC Certificate Related Data May be Needed"
    HTS codes assigned a CP1 flag identify product categories where certification requirements may apply depending on the specific product being imported. Additional review may be necessary to determine whether electronic certificate filing is required. 
  • CP2: "CPSC Certificate Related Data is Required"
    HTS codes assigned a CP2 flag identify product categories for which certificate-related information is required when importing covered products. 

In addition, a small number of HTS codes had their flag designations changed since the April 2026 version — notably, liquid nicotine product codes (HTS 2404.12) were reclassified from CP2 to CP1. The full details of all changes are available in the Change Log tab of the updated document.

The new format is intended to provide greater clarity to importers, customs brokers, manufacturers, and other supply chain stakeholders by distinguishing between HTS codes that may trigger certification review and those that generally require certificate data submission.

Important reminders

  • The HTS list does not cover all codes where an eFiled certificate may be required. The importer is responsible for eFiling whenever a certificate is required, regardless of whether the HTS code appears on this list.
  • Any entry with an eFiled certificate (a CPSC PGA Message Set) is subject to CPSC's 1USG Messaging process. Importers should review CPSC's 1USG Messaging guidance for additional product categories that undergo this process even without a certificate.

What you should do now

  • Review the updated HTS list against your product portfolio to confirm which flag, CP1 or CP2, applies to each of your imported product categories
    For CP2 flagged codes, confirm that eFiled certificate data is being transmitted for every applicable entry
    For CP1 flagged codes, assess whether your products within those codes are subject to a CPSC rule, regulation, ban or standard and file accordingly; consider voluntary disclaim messages where products are not regulated
    Review the Change Log tab to identify any codes where flag designations have changed since April 2026
