Specific limitations
Have in mind that for components of your food packaging materials either specific migration limits or residual monomer contents apply according to the Code of Federal Regulations. Sections 175 to 182 cover a wide range of materials as well as substances defining the specifications and restrictions.
Exemptions from individual FDA clearance
Producers should use substances in food contact materials that are generally recognised as safe (GRAS). In addition, if food contact materials are already cleared as safe prior to 1958 or subject to a food contact notification (FCN) or their exposure to consumers is under a generally safe level (Threshold Of Regulation, TOR), they are exempted from individual clearance by the FDA.
California Proposition 65
Be aware that your importers to the state of California need to consider California Proposition 65, the “Safe Drinking Water and Toxic Enforcement Act”. Consumers need to be warned in case a product contains substances which are known to cause cancer, birth defects or other reproductive harm. Certain substances listed in California Proposition 65 are subject to a safe harbour level which could relieve business operators from this duty provided consumer exposure is below this safe harbour level.
