Washington passes the strongest legislation on chemicals in consumer products 

 

On 8th May 2019, Washington’s governor signed into law SB5135 regulating toxic chemicals in consumer products. This law will become effective on 28th July 2019.

 

The law,  the Pollution Prevention for Our Future Act, specifically covering following bold action:

 

  • Directs the Department of Ecology to designate at least five priority chemicals. The first chemical classes to be addressed in products include phthalates, PFAS, flame retardants, phenolic compounds and PCBs.
  • Directs the Department of Ecology to identify priority consumer products that are a significant source of or use of priority chemicals and to take action to reduce the sources.
  • Directs the Department of Ecology to prioritize the next classes of chemicals after recommendations on the first round priority chemicals and products are finalized.

By 1st June 2020, the Department of Ecology shall identify its first priority products and determine regulatory actions to address these two years later. Additionally the Ecology Department must adopt rules to implement the regulatory actions by 1st June 2023.

 

Under this law, manufactures may be required for notification, such as providing lists of products containing priority chemicals, product ingredient disclosure or information regarding exposure and chemical hazard.
